2 Defenses to Claim for Conversion
(1) Fla. R. Civ. P. 1.110(d) (pleading affirmative defenses), and other standard defenses. See § 1.
(2) Statute of Limitations: § 95.11(3)(h), Fla. Stat. (four years); see Small Business Admin. v. Echevarria, 864 F. Supp. 1254, 1260 (S.D. Fla. 1994); Bobo’s Drugs, Inc. v. Fagron, Inc., 314 F.Supp.3d 1240, 1243 (M.D. Fla. 2018).
(3) Breach of contract or other obligation to pay money does not, without more, give rise to conversion claim. See Misabec Mercantile Inc. de Panama v. Donaldson, Lufkin & Jenrette ACLI Futures, Inc., 853 F.2d 834, 837 (11th Cir. 1988); Transcapital Bank v. Shadowbrook at Vero, LLC, 226 So.3d 856, 864 (Fla. 4th DCA 2017).
(4) “The generally accepted rule is that demand and refusal are unnecessary where the act complained of amounts to a conversion regardless of whether a demand is made . . . . while a demand and refusal constitute evidence a conversion has occurred, it is unnecessary to prove a demand and refusal where the conversion can be otherwise shown. ” Hodges v. Harrison, 372 F.Supp.3d 1342, 1351-52 (S.D. Fla. 2019)(quoting IberiaBank v. Coconut 41, LLC, 984 F.Supp.2d 1283, 1308 (M.D. Fla. 2013)); Orozco v. McCormick 105, LLC, 276 So. 3d 932, 935 (Fla. 3d DCA 2019); see also Columbia Bank v. Turbeville, 143 So.3d 964, 969 (Fla. 1st DCA 2014) (holding dismissal with prejudice based on failure to demonstrate demand and refusal was in error where the facts alleged would otherwise establish a conversion had occurred).
(5) Conversion cannot be based on taking of “fungible” money that is not capable of specific identification. See Florida Dept. Ins. v. Debenture Guaranty, 921 F. Supp. 750, 757 (M.D. Fla. 1996); Transcapital Bank v. Shadowbrook at Vero, LLC, 226 So.3d 856, 864 (Fla. 4th DCA 2017); JONATHAN HARRINGTON, Plaintiff, v. VERITEXT, LLC, Defendant., No. 24-CV-22787, 2025 WL 1591614, at *16 (S.D. Fla. May 1, 2025).

(6) Plaintiff does not own, or possess rights to, the property in question. See Page v. Matthews, 386 So.2d 815, 816 (Fla. 5th DCA 1980); See also Catano v. Capuano, No. 18-20223-Civ-TORRES, 2020 WL 639406, at *11 (S.D. Fla. February 11, 2020) (explaining a future interest does not equate to a possessory right over the property in question).
(7) Plaintiff consented to defendant’s possession of the allegedly converted property. See National Bank of Melbourne & Trust Co. v. Batchelor, 266 So. 2d 185, 187 (Fla. 4th DCA 1972); Premier Gaming Trailers, LLC v. Luna Diversified Enterprises, Inc., No. 8:16–cv–3378–T–33TGW, 2018 WL 2238060, at *3 (M.D. Fla. May 16, 2018).
(8) Real property cannot be the subject of an action for conversion. See Palm Beach Florida Hotel v. Nantucket Enterprises, Inc., 211 So.3d 42, 45 (Fla. 4th DCA 2016); American Intern. Land Corp. v. Hanna, 323 So.3d 567, 569 (Fla. 1975).
